Russ Whitney’s lawyer Scott Rothstein reneged on his promise to reimburse John T. Reed for making Reed rebook travel plans, and Russ Whitney and Rothstein defied the court’s order to reimburse Reed

On May 9, 2005, Russ Whitney’s attorney Scott Rothstein sent me an email asking me to agree to postpone the evidentiary hearing scheduled for May 13, 2005 in Fort Myers, FL. I live in California. The hearing was scheduled at Whitney’s request. I was ordered to attend in person. But I was going to question Russ Whitney under oath at the hearing. Rothstein’s email contained the following promise:
“If it cost you anything as a result of the change, my firm would be more than happy to reimburse you for the additional expense.”
I said, “No” regarding the postponement. Later that same day Rothstein sent me another email that said in part,
“If you were to agree to the continuance what would you lose as I am agreeing in writing to pay any substantiated cost out of my pocket.”
I refused to trust Rothstein on the matter of reimbursement. When Rothstein filed a motion to get the court to delay the hearing, he told the court he would reimburse me for expenses caused by the postponement. My opposition to the postponement asked the court to order the other side to reimburse me if they granted the postponement.
The Court ordered the hearing postponed from May 13, 2005 to June 15, 2005. The federal magistrate judge said in his order granting the postponement,
“IT IS FURTHER ORDERED:
1. Plaintiffs Whitney Information Network, Inc. and Russ Whitney or their counsel shall reimburse the Defendant John T. Reed for all of the reasonable expenses that he incurred to travel to Fort Myers for the May 13, 2005 hearing, including any Federal Express shipping charges incurred by him for sending documents to Fort Myers, and the cost of returning them to him in California.”
On May 10, 2005, Scott Rothstein sent me this email:
“Given the courts ruling continuing the hearing until june 15th, I would appreciate it if you would please send me something advising as to the monies you incurred so that I can reimburse you immediately.”
On that same day, I sent Scott Rothstein the following email:
“I have cancelled and rebooked the trip to Fort Myers.
I lost $89.50 because the deadline the first night of my hotel was noon CST on 5/10/05. I did not get the court's fax until after that time. I saved the $25 cancellation on the second night by rebooking it for June.
The airfare went up $770 over the previous airfare. I don't know why. Maybe summer is more of a peak travel time. Maybe mid week costs more than Friday-Saturday.
The rental car went down by $11.28, perhaps because of more notice.
I do not yet have Federal Express bills.
Accordingly, the amount you owe thus far is $89.50 + $770 - $11.28 = $848.22.
I believe that covers the travel. I will send the FedEx amount when I get it.

Rothstein responded that same day,
“I am sending a check tomorrow.”
Ha!
I got nothing! No check. No money order. Nothing.
It is now June 13, 2005—more than a month after the promises and the federal court order. Scott Rothstein reneged on his promises to me and to the court and he and Russ Whitney are defying the court’s order to keep that promise.
What’s next? I ask the court to hold them in contempt.
And if they still do not pay? I believe the next step is the court issues a warrant for someone’s arrest. The mother of Whitney’s out-of-wedlock child did not get back child support from Whitney for their child until the Lee County court started threatening him with arrest after he defied the court’s previous orders.

CONSUMER WARNING NOTICE: I recently saw Russ Whitney on a late night TV infomercial and then attended one of his "free" seminars. Unfortunately I believed all of their LIES and FRAUDULENT CLAIMS and I paid thousands of dollars to go to his "training camps". Needless to say I was clearly ripped off, cheated and lied to by Russ Whitney and his employees (band of thieves). My mistake was not searching the Internet to find out more about Russ Whitney and his company's HORRIBLE reputation for fraud, deception and illegal activities. Had I searched online I would have found out about THOUSANDS of customers being cheated, HUNDREDS of investigations by the Attorney General into the fraud of Russ Whitney and his company's, and that Russ Whitney himself is a CONVICTED VIOLENT FELON and spent years in PRISON. I saved the cached pages from the major search engines of the John Reed lawsuit with Russell Whitney and the TRUTH and FACTS that Reed discovered during his investigation of Whitney. I am posting this information on real estate discussion boards so other people do NOT get cheated and ripped off like I did.
