Current status of Russ Whitney’s litigation against John T. Reed

A number of people have asked me to clarify the status of Russ Whitney’s litigation against me.
There are presently two cases in which I am a defendant:

Accuse Reed of Trademark infringement and similar things, defamation per se, and tortious interference with business relationships
Reed counterclaimed for violation of the Cybersquatter Consumer Protection Act (using Reed’s name in a domain name registered by Whitney), tortious interference with business relationships, and abuse of process

Yates is a former Whitney in-house paralegal
Reed is accused of tortious interference with a business relationship between Whitney and Yates and of illegally obtaining Whitney trade secrets from Yates.
Whitney is also suing a company that hosted my Web site in Fort Myers federal court.
Whitney withdrew a federal case that was the first they filed in Fort Myers. They subsequently sued me in Fort Lauderdale state court, and Miami federal court. I moved the Fort Lauderdale state case to federal court in Fort Lauderdale. Whitney consolidated the Miami case to Fort Lauderdale federal court. Then they let the Fort Lauderdale cases be moved back to Fort Myers.
Whitney has pending a motion to dismiss my counterclaims in federal court. I filed an opposition to that. I have a motion pending for summary judgment in the federal case. If Whitney wins the motion to dismiss, that means they win with regard to my counterclaims. If the court grants me summary judgments it means I win the claims Whitney has against me.
Whitney also has motions for preliminary injunctions pending against me in both courts. I opposed both: Lee County injunction opposition, Fort Myers federal injunction opposition
Preliminary injunctions would remove all mention of Russ Whitney or Whitney Information Network by name from my Web site thereby making it extremely difficult for people to find what I say about him.
I moved the state court to dismiss the case. I lost and now have 30 days to answer that complaint.
Trial date
The federal trial is scheduled for October 4, 2005. May 6, 2005 is the discovery deadline.
There is no trial date yet for the Lee County case.

CONSUMER WARNING NOTICE: I recently saw Russ Whitney on a late night TV infomercial and then attended one of his "free" seminars. Unfortunately I believed all of their LIES and FRAUDULENT CLAIMS and I paid thousands of dollars to go to his "training camps". Needless to say I was clearly ripped off, cheated and lied to by Russ Whitney and his employees (band of thieves). My mistake was not searching the Internet to find out more about Russ Whitney and his company's HORRIBLE reputation for fraud, deception and illegal activities. Had I searched online I would have found out about THOUSANDS of customers being cheated, HUNDREDS of investigations by the Attorney General into the fraud of Russ Whitney and his company's, and that Russ Whitney himself is a CONVICTED VIOLENT FELON and spent years in PRISON. I saved the cached pages from the major search engines of the John Reed lawsuit with Russell Whitney and the TRUTH and FACTS that Reed discovered during his investigation of Whitney. I am posting this information on real estate discussion boards so other people do NOT get cheated and ripped off like I did.
