Property Inspection Affidavit

(When investor sells with LO tenant/optionee signs)

PROPERTY ADDRESS:___________________________________

I/We understand and agree that the property is being leased with an option-to-buy in an “as is” condition.

In this transaction, I/We understand the Landlord has made reasonable efforts to disclose any general defects in the areas of appearance, systems functionality, and structural integrity of the Property.

I/We understand that while reasonable efforts have been made by the Landlord to provide accurate information regarding the condition, functionality, and structural integrity of the Property, it is the undersigned’s responsibility to make the necessary arrangements for professional inspection to OUR satisfaction.

We understand that the purpose of a property inspection is NOT to compel the Landlord to make corrections or improvements of any discovered defects or deficiencies. It is for the purpose of deciding whether or not I/we will consummate the transaction and accept the responsibilities at the agreed upon terms of the lease and option.

We understand that if I/we do not arrange for professional property inspection, we do so of our own free will and fully accept the responsibilities of any undiscovered defects and deficiencies.

I/We fully acknowledge that the Landlord has given us sufficient time and access to fully inspect the Property as to its overall condition including, but not limited to: overall appearance, systems functionality and structural integrity.

By signing this affidavit, we acknowledge that I/we (or our retained professional inspectors) have fully inspected the property and we are satisfied with its condition. We hereby fully accept the property and the responsibilities thereof in “as is” condition and there will be NO REFUNDS of any monies paid to Landlord.
